Legislators Return to the Capitol This Week

January 08, 2008

The legislature reconvened on Monday, January 7, 2008, to begin the second year of the two-year legislative session. Housing California will begin to review newly introduced bills for affordable-home and homelessness-related content and will continue to work on any two-year bills heard in committee on which we have taken a position.

All two-year bills may be heard in their last location (in committee or on the floor) at the author’s discretion and must pass out of the house in which they were introduced by January 31, 2008. The deadline to introduce new bills is February 22, 2008. View the entire legislative calendar online.

Governor Schwarzenegger delivered his State of the State address on Tuesday, January 8, and is expected to release his recommended budget on Thursday, January 10. View more information and webcast.

Housing California's 2-Year Bills in Their House of Origin

Authors indicated that the following bills WILL be heard in committee:

  • AB 9 (Huff) Voter identification: proof of identity.
    Summary: Requires any eligible citizen to present proof of his or her identity to a member of the precinct board before receiving a ballot.

  • AB 842 (Jones) Regional plans: traffic reduction.
    Summary: Requires all funds from Prop 1B and 1C bonds to be spent on projects in cities/counties where the council of governments/county has adopted a plan to reduce vehicle miles traveled (VMT) AND the city/county has amended its general plan to implement the council of government’s goal. Calendar: 01/16/08 9 a.m. - Room 126 ASM HOUSING AND COMMUNITY DEVELOPMENT

  • AB 1017 (Ma) CEQA.
    Summary: Requires certain appeals of CEQA decisions to be filed within 30 days of the decision.

  • AB 1129 (Arambula) San Joaquin Valley Regional Affordable Housing Trust.
    Summary: Establishes the San Joaquin Valley Regional Affordable Housing Trust as a voluntary collaboration between councils of governments, CA Partnership for the San Joaquin Valley, and affordable home advocates and developers.
    Calendar: 01/16/08 9 a.m. - Room 126 ASM HOUSING AND COMMUNITY DEVELOPMENT

  • AB 1675 (Nunez) Greenhouse gas emissions: Department of Transportation: purchasing specifications.
    Summary: Relates to CalTrans fleet vehicle purchases.

  • SB 464 (Kuehl) Rental property: public entity restrictions.
    Summary: Requires a new buyer to maintain ownership of a building for more than 5 years before they are permitted to evict under the Ellis Act exception.

Authors indicated that the following bills will NOT be heard in committee:

  • AB 29 (Hancock) Infill development: incentive grants.
    Summary: Designates HCD as the administering agency, with funds to be used for parks, urban greening, water and sewer, and transpiration improvements.

  • AB 148 (Alarcon) Sex offenders.
    Summary: Authorizes the lessor of a residential property to refuse to provide housing to, or evict, a sex offender whose address is made available on the Department of Justice web site.

  • AB 274 (Coto) Taxation: credit: brownfield cleanup.
    Summary: Authorizes a tax credit equal to the cost of clean-up to brownfield property owners who clean their property to the satisfaction of the Department of Toxic Substances Control.

  • AB 725 (Lieber) Housing: universal rental housing application.
    Summary: Requires HCD to develop a universal rental housing application for any development that receives state funding.

  • AB 792 (Garcia) Environmentally Sustainable Affordable Housing Program.
    Summary: Appropriates Prop 1C’s $100 million for "innovative financing" to three new programs: Construction Liability Insurance Reform Pilot Program; Green Building, Energy Efficiency, and Building Design Program: and Affordable Housing for Teachers Program.

  • AB 884 (Dymally) Low-income housing tax credit allocation program.
    Summary: Makes changes to the state and federal Low Income Housing Tax Credit Program.

  • AB 1231 (Garcia) Infill development: incentive grants.
    Summary: Contains the administration’s proposal for Prop. 1C's infill funding.

  • AB 1256 (Caballero) Density bonus: exemption: local inclusionary ordinance.
    Summary: Exempts local agencies from the Density Bonus Law if they adopt an inclusionary ordinance.

  • AB 1449 (Saldana) Density bonus.
    Summary: Makes changes to Density Bonus Law.

  • AB 1538 (Lieu) Housing Trust Fund: home loan refinance assistance.
    Summary: Will be amended to impact 1C.

  • ACA 2 (Walters) Eminent domain.
    Summary: Prohibits local governments from transferring property acquired using eminent domain to a private party or for a private use.

  • SB 58 (Hollingsworth) CalWORKs program.
    Summary: Requires that an adult be removed from CalWorks after s/he has received aid for the 60-month period, but would permit children in the assistance unit to continue to receive assistance if certain conditions are met.

  • SB 122 (Steinberg) Hate crimes: homelessness.
    Summary: Expands the definition of a hate crime to include homeless status.

  • SB 818 (Negrete McLeod) Correctional facilities.
    Summary: Expresses intent to enact legislation to fund the construction of rehabilitation programming facilities that would be operated by the Department of Corrections and Rehabilitation.

  • SCA 1 (McClintock) Eminent domain: condemnation proceedings.
    Summary: Requires that property acquired by eminent domain be owned and occupied by the condemner and used for the public purpose stated at the time of taking.
