Housing CA Opposes SB 1165

Planning and Conservation League-sponsored SB 1165 (Kuehl) makes the following changes to the California Environmental Quality Act (CEQA):

  • Requires a lead agency to consider and retain all written communications regarding a project or its Environmental Impact Report (EIR);
  • Requires a lead agency to make drafts circulated to the project applicant available when the draft EIR is released for public comment; and
  • Requires a lead agency to treat an EIR more than five years old as a draft.

Although Housing California supports the goals of CEQA, we oppose SB 1165. It would make the development of affordable homes more difficult, would lengthen the CEQA process, and may increase the risk of litigation. SB 1165 will be heard in Senate Appropriations on May 19, 2008.
